Note on Compliance with the Legal Requirements of the German Electrical and Electronic Equipment Act (“ElektroG”) § 7a for B2B-customers

Introduction

According to the EU Directive 2002/96/EC of the European Parliament and the EU Council on Waste Electrical and Electronic Equipment (WEEE), or the revised version of the aforementioned EU Directive 2012/19/EU, an obligation was established also within the B2B sector to collect waste from electrical and electronic equipment, to dismantle it in accordance with the aforementioned regulations, to dispose of it and to bear the costs for the said.

The purpose of this Directive is to contribute to sustainable production and consumption by, as a first priority, the prevention of waste electrical and electronic equipment (hereinafter referred to as the “WEEE”) and, in addition, by the re-use, recycling and other forms of recovery of such waste so as to reduce the disposal of waste and to contribute to the efficient use of resources and the retrieval of valuable secondary raw materials. Under the Electrical and Electronic Equipment Act (ElektroG) in effect in Germany, every manufacturer is obligated to provide a suitable option for the return of waste equipment from non-household users.

comemso electronics GmbH assumes responsibility for the products it manufactures and sells, which are subject to the applicable legal requirements, and recycles them by a high-quality recycling process after use when they become waste. For devices that have been used commercially or in public institutions – so-called B2B devices – we have provided adequate as well as convenient return and disposal solutions.

comemso electronics GmbH is registered in the terms of the German Electrical and Electronic Equipment Act (“ElektroG“), respectively its § 7a as a manufacturer for B2B-customers with the registration brand “comemso electronics” and the type of equipment “Large equipment for use in other than private households only” (equipment assigned to category no. 4) at the “stiftung ear® elektro-altgeräte-register®”, Nordostpark 72, D-90411 Nuremberg, under the registration number DE92918008.

comemso electronics GmbH takes the WEEE manufactured and/or sold by it primarily back by itself, but has also concluded a contract with a reputed recycling company. This company together with its recycling partners, organizes the handling, processing, preparation for re-use, recycling of and recovery of reusable materials from the WEEE. In doing so, comemso electronics GmbH bears by itself the costs the for handling, recycling and recovery of WEEE from it. In return, comemso electronics GmbH asks its customers to bear by themselves the costs of transport to comemso electronics GmbH’s premises as the manufacturer or to the specified recycling company.

Options for Returning and Disposal of Waste Electrical and Electronic Equipment

If you would like to dispose of a WEEE (or several) produced by and/or purchased from comemso electronics GmbH in accordance with the applicable legal provisions, you do have the option/s of commissioning either a parcel service of your own choice or – depending on the size and weight of the waste equipment – a freight forwarder of your choice in order to send the electrical waste equipment to us or to the recycling partner to be designated by us.

Upon the receipt of the take-back- request, this will be checked, registered, processed, and provided with a tracking ID; subsequently, you will receive a message to the eMail address you entered (therefore, please check this for accuracy before sending), message which will display our address as recipient of the WEEE or alternatively that one of the specified recycling company, in addition, the sender (your data, respectively that of your company as applicant) as well as other information necessary for the further processing of your request. Please print out the address data for the shipment and attach the printout clearly visible on the return shipment of the WEEE. By submitting your WEEE take-back application, you implicitly consent to the sharing of the submitted data with our recycling partners, insofar such may be necessary for the further processing of your application/request.

Personal Responsibility with Regard to the Deletion of Personal Data

We would explicitly like to point out that any personal data on the WEEE to be disposed of have to be deleted by you yourself.

Meaning of the Symbol for the Marking of Electrical and Electronic Equipment

The below shown crossed-out wheeled garbage bin symbol applied on electrical and electronic equipment indicates the necessary separate collection of WEEE and means that it must not be disposed of together with household waste.
